Employment Lawyer Welcome New Level Of Transparency

A leading employment lawyer has welcomed an announcement that the right to itemised pay statements will be extended to all workers.

The Employment Rights Act 1996 has now been amended so that from 6 April 2019, every worker will have the right to be given a written itemised payslip at or before the time at which any payment of wages or salary is made to them.

Payslips currently need to include the gross amount of the wages or salary, the amounts of any variable and any fixed, deductions from that gross amount and the purposes for which they are made. 

From next April, The Employments Right Act 1996 (Itemised Pay Statement) (Amendment) Order 2018,  will mean that where the amount of wages varies by reference to time worked, the statement should include the number of hours worked in respect of the variable amount of wages or salary. This needs to be as a single aggregate figure, or separate figures for the different types of work or different rates of pay.

Worker will be entitled to make a reference to an employment tribunal to determine what particulars ought to have been included or referred to in a statement if bosses fail to comply.
