Medical Negligence Lawyers At Irwin Mitchell Secured Settlement

A care and rehabilitation package has been agreed for a five-year-old boy from Brighton who developed cerebral palsy following complications during his birth after specialist medical negligence lawyers at Irwin Mitchell secure an admission from the NHS Trust responsible for his care.

The young boy, from Brighton has four-limbed athetoid cerebral palsy due the injury he sustained at his birth. Expert medical evidence found that midwives failed to notice a prolapsed cord and that if he had been delivered 11 minutes earlier by the midwives, he would have not suffered a brain injury, but instead he will be entirely dependent on others for the rest of his life.

His parents instructed specialist medical lawyers at Irwin Mitchell to help them obtain answers as to what happened and to secure funds for the lifetime care, support and rehabilitation he will need.

Two years ago the Brighton and Sussex University Hospitals NHS Trust responsible for his injuries admitted failings and apologised to the family. Interim settlement payments allowed the family to access specialist rehabilitation.

Now following a hearing at High Court, a £11.5 million settlement has been agreed for him so that he will have access to specialist treatment for the rest of his life, including £1m for future education costs if the Local Authority place him in an unsuitable school.

He has had the benefit of a large interim payment and this has funded a move to more suitable rented accommodation with his parents, a team of carers, a team of therapists, specialist equipment and a wheelchair adapted vehicle.

Irwin Mitchell’s Public Law and Court of Protection teams have also given the young boy’s family help and support throughout the legal proceedings. A deputy has been appointed from the Court of Protection team, who will manage the funds for the young boy.
