Travel Lawyers At Irwin Mitchell Secure Settlement Following Nightmare Stay At Tropicana Rosetta & Jasmine Club
A Darlington woman says she is relieved to be able to put her terrible Egyptian holiday experience behind her after expert travel lawyers at Irwin Mitchell secured her a £22,500 settlement after her trip was ruined by gastric illness.
Mandy Davis, 32, booked a ten-day stay at the Tropicana Rosetta & Jasmine Club resort in Egypt with tour operator TUI UK Ltd in October 2013, but just days into what was supposed to be a relaxing holiday with her former partner she began to suffer with diarrhoea, vomiting, stomach cramps and a fever.
She instructed specialist international personal injury lawyers at Irwin Mitchell to investigate the cause of her illness, which led to her losing a significant amount of weight and she continues to suffer problems related to the illness she suffered even now, some 18 months on.
Her expert legal team at Irwin Mitchell has now secured a five-figure settlement from TUI UK Ltd which admitted primary liability for her illness.
After her holiday Mandy’s symptoms continued on her return to the UK and she regularly visits her GP due to the on-going issues she suffers.
She told specialist travel lawyers at Irwin Mitchell that during her stay at the three-star Tropicana Rosetta & Jasmine Club in Sharm-el-Sheikh resort she occasionally witnessed food on the buffet being exposed for long periods of time, sometimes noticed fresh food being added to old food and saw some birds and flies in the restaurant while food was being prepared and served.
Jatinder Paul, an expert travel lawyer at Irwin Mitchell, who represented Mandy, said:
Expert Opinion
“Mandy’s case shows just how much of an impact an illness can have, as she continues to suffer with problems related to her illness almost 18 months after returning to the UK.
“She has been forced to alter her diet to reduce the frequency of these problems and we are now delighted to have secured a settlement for Mandy to cover the cost of her ruined holiday and the on-going problems she endures on a day-to-day basis.
“It is important that tour operators take note of this case and ensure that their customers’ health is protected by ensuring the hotels they are advertising have the appropriate hygiene standards.
“We are pleased to have agreed a fair settlement with TUI UK Ltd and we hope that Mandy will now be able to put her terrible ordeal behind her and continue her road to recovery after suffering such terrible symptoms.” Jatinder Paul - Partner
Mandy, a social worker, said: “Holidays are supposed to be relaxing and enjoyable, but the ten days spent at this resort were absolutely awful and my on-going health issues related to the illness I suffered act as a constant reminder of my terrible experience.
“I’m so relieved Irwin Mitchell has secured this settlement so I can start to put my terrible ordeal behind me. No amount of money can make up for the impact this illness has had on my life, but now that I know TUI will be held responsible for the failings at the resort, I can begin to move forward with my life.
“I can only hope my case has helped to improve the food and hygiene standards at the resort and other people staying there don’t have to suffer in the same way I have.”
