Specialist industrial disease lawyers have secured a six-figure sum in compensation for a man who developed Carpal Tunnel Syndrome as a result of his employment.
Our client, an employee of a fabrication company based in Ipswich, was signed off work in April 2014 after developing Carpal Tunnel Syndrome in his right wrist. The symptoms were believed to be caused by using angle grinders and other tools, which produced excessive amounts of vibration.
Despite undergoing surgery to try and improve the situation, he was still left with pain in his wrist and, in February 2015, he was dismissed from his employment on incapacity grounds.
From April 2014 onwards, our client suffered a significant loss of earnings and sadly he had to sell his family home in mid-2014, as he was struggling to afford the mortgage repayments.
After leaving his employer in February 2015, our client was unemployed for a few months before securing another job. However, he was also dismissed from this job because he couldn’t do any work involving heavy lifting, as his Carpal Tunnel Syndrome was still affecting him.
Our client contacted us in February 2015 to help him claim damages from his former employers. Unfortunately, the employers refused to claim responsibility. In November 2016, court proceedings started. To prepare for the potential trial, we gathered expert medical evidence to prove our client’s Carpal Tunnel Syndrome resulted from his work.
A clinical psychologist provided evidence on the emotional trauma our client faced from losing his job and having to sell his family home. An expert engineer also gave evidence and carried out a site inspection of the employer’s premises to examine the vibration levels produced by the tools our client used.
With this evidence and the with the trial date looming in early 2019, our client and his former employer agreed upon a six-figure settlement in November 2018.
Our client and his wife were delighted at the outcome and were relieved they would not have to go to court. He is now able to pay off the mortgage on his new home and is glad that he is finally able to put the events of the past few years behind him.
