Dealing With Manual Handling Work Accident Claims With Expertise And Sensitivity

If you’ve suffered an injury from manual handling at work, we can help you make a work accident compensation claim against your employers.

Manual handling concerns ‘any transporting or supporting of a load (including the lifting, putting down, pushing, pulling, carrying or moving thereof) by hand or by bodily force’ which as can be seen is extremely wide ranging.

According to HSE statistics, manual handling accidents account for 40% of accidents at work, and can result in:

  • Back injuries
  • Upper and lower limb injuries
  • Muscular injuries
  • Worsening of pre-existing conditions

In minimising the risk to an employee the employer has to firstly take all reasonable steps to avoid the manual handling task. If it is unavoidable then an employer has to assess the procedure to be used and in doing so take any appropriate steps to reduce the risk of injury to the lowest level possible. Whilst assessing the procedure the employer also has to take into account the individual employee's suitability for the procedure and any affect this may have on decisions made.

Each worker should be notified of any risks identified in the risk assessment.

As experts in dealing with manual handing accident claims, we regularly find that employers fail to:

  • Provide suitable lifting equipment
  • Organise the work appropriately
  • Provide adequate manpower
  • Provide proper training

As a result of this, many people suffer injuries because they have been involved in an accident at work. Irwin Mitchell can help you if you have been involved in an industrial accident and wish to seek compensation.

Compensation for Nurse following Accident at Work

A nurse has received £5,000 compensation for injuries following a manual handling accident at work.

Our client worked as a staff nurse at the time of the accident. It is believed that she sustained the injury because she had to lift heavy bags of fluid onto equipment for a patient’s treatment. This had to be carried out in cramped conditions, in an awkward position and no hoist was provided to assist with the lifting.

As a result of the injury, she has had to change her role at work and her ability to do some of her household tasks and hobbies has been affected.

The case was settled before trial with help from Louise Morgan in Irwin Mitchell's Accidents at Work team.

She said, "It is important that employers try wherever possible to remove or reduce the need for their employees to manually lift items by providing equipment to assist and thereby lessen the risk of injury."
