Handling Fall From Height Claims With Expertise And Sensitivity

With a team of specialist industrial accident solicitors, Irwin Mitchell could help you to make a compensation claim if you have suffered a fall at work.

Falls from height claims are not uncommon in the UK, especially in construction occupations where they are the largest cause of fatal and major work related injuries. Equally, falls from height can happen in warehouses and offices (e.g. maintenance personnel fixing lights/washing windows) - or simply as a result of a trip or fall down stairs.

Here are some common examples of falls at work:

  • Falls through fragile material such as skylights or unsafe tiles
  • Falls from steelwork, ladders, stairs, edges, openings and scaffolding

Employers can reduce the risk of staff being injured in falls from height by investigating safer alternative working methods. For example, it might be possible to complete certain jobs from ground level if the correct equipment is available.

If a particular task has to be completed at height, suitable and sufficient measures must be in place to prevent an employee falling a distance likely to cause injury. Such measure might include barriers or harnesses.

If you feel your employer has not provided sufficient protection against your fall from height, you may be able to claim compensation for your accident.

Proven Expertise In Fall Claims

We have a dedicated work accident team with experience of many successful claims involving falls from height. If necessary our solicitors will visit the site of your accident to assess the measures in place to prevent a fall, often with the help of an experienced consultant engineer. This kind of thorough research gives you the peace of mind that your claim is in good hands.

£1.2m Spinal Injury Case

£1.2m Spinal Injury Case

Our specialist spinal injury team in Sheffield assisted a former warehouse operative in securing a £1.2m damages settlement following an accident in 2005 at his place of work, which lead to him suffering incomplete paraplegia. Barry, 60, was left with severely reduced mobility when a lift-truck which he was operating at his place of work in Boston plummeted to the ground, fracturing his spine.

The Sheffield team secured an early admission of liability from his employer and a substantial interim payment enabling Barry and his wife to move into a fully adapted new bungalow within 18 months of the accident.

Neil Whiteley, who represented Barry along with his colleague Rachael Aram, stated "by bringing in our client liaison team at an early stage, and later a specialist spinal injury case manager, we were able to assist Barry and his wife through what was undoubtedly a very difficult time, just when they were beginning to look forward towards their retirement. Both have done fantastically well, and it has been a pleasure to work for Barry to achieve this result".
