Expertise And Understanding From Irwin Mitchell

Tinnitus is a condition that can often be caused by working conditions, particularly among those working with industrial equipment or in call centres. Employers have a responsibility to protect all aspects of their employee’s health and safety and that includes their hearing. In recent years there has been a notable increase in the number of employees suffering from hearing problems such as acoustic shock or tinnitus.

Above all, we put you first.

Handling Work-Related Tinnitus With Expertise And Sensitivity

If you work or have worked in a noisy environment for a length of time and now find that you have a permanent ringing, whistling, buzzing or humming noise in your ears or head, you may be suffering from tinnitus.

These noises can be heard either in one ear, in both ears or in the middle of the head. The noise can be low, medium or high pitched. In more severe cases the noise may be continuous - but it usually comes and goes in irregular patterns.

In many cases, there is no specific treatment for tinnitus. It may simply go away on its own, or it may be a permanent disability Solutions can include:

  • equipment such as a tinnitus masker which creates ‘white noise’ that can distract from the noise of the tinnitus
  • a sound pillow
  • tinnitus retraining therapy

Tinnitus can commonly be attributed to working conditions. Those who have worked in call centres, with industrial machinery or in other noisy work environments could have developed some form of tinnitus or other hearing problem.

If your hearing problem can be traced back to either your current or a previous employment, you could be entitled to make a claim for tinnitus compensation.

As one of the UK’s leading firms of solicitors involved in occupational injury claims, we’ve represented over 200,000 people in the UK with employment-related conditions such as tinnitus. In the past, our team have worked on industrial injury claims in construction, engineering, textile and mining industries, to name a few.

Our industrial injuries team will help you to establish if your case of tinnitus can be linked to your exposure to excessive noise at work and, crucially, whether your employer was negligent and failed in their duty of care. If this is the case, we can help you to pursue a tinnitus compensation claim.

Compensation for Tinnitus and Hearing Loss

Mr Perks was a former steel worker in the Black Country between the 1960’s and 2002. He is now aged 63 and suffers with hearing loss and tinnitus which has been caused as a result of his exposure to excessive noise at work. Whilst Mr Perks was provided with hearing protection in approximately 2000, the damage caused by noise had already been done.

It was not until 2006 that Mr Perks came to realise a problem with his hearing when his wife started to point out that he was missing conversations and that the television was too loud. He has also since started to suffer with a constant high pitched whining known as tinnitus, also caused as a result of the noise to which he was exposed.

We were able to settle Mr Perks' claim against the former employers for the total sum of £9,500.

David Johnston-Keay of Irwin Mitchell Solicitors is pleased with the result. "Mr Perks worked in a heavy industry and was exposed to some very noisy equipment.  Whilst his employers finally did something about the noise in around 2000, Mr Perks had already been working in the noise over 35 years and the damage caused was irreversible.  The compensation which Mr Perks has accepted should go some way in helping him cope better with the condition, perhaps by giving him the means to buy some quality hearing aid. However, no amount of money will ever replace his hearing."
