£750,000 for Former Female Sergeant after Military Accident

A former female Sergeant was awarded £750,000 in an out of Court settlement by way of compensation for injuries and financial losses suffered in an incident in 2004.

Our client was on the shooting ranges in Iraq when a former colleague (a Master Sniper) accidentally shot her in the knee at point blank range.

She required emergency treatment in Iraq before being returned to the UK where she was treated at Selly Oak and Queen Elizabeth hospital. Her treatment continues and it is indicated that she will require total knee replacement within 10-15 years of the date of injury with replacements for life.

Our client was medically discharged from the army and a very promising career, in which she contended that she would have applied for, and achieved either a Commission or extended service to age 55. The fact that she would have completed 22 years service was not in issue.

The award compensated our client for her pain and suffering as a result of the military accident and ongoing treatment which will be required. It also compensated her for the difference between her anticipated earnings from her military service and her residual earning capacity in civilian employment.

It allowed her the costs of undertaking surgery privately in the future and includes accommodation expenses from the date of her medical discharge to the date of her pre accident retirement from the army, and past and ongoing care costs associated with her injury and disability. It also included her pension and lump sum terminal grant loss as a result of early retirement from the army.
