Over £5 Million For Man Paralysed In Work Injury

Mr Pullen is now 66. On 22 July 2005, he was injured at work. He was struck by falling boxes and was pinned to the ground. He sustained a spinal injury as a result.

Mr Pullen was paralysed from the waist down with very minimal movement in his hands. Liability was secured at an early stage, enabling us to secure significant interim payments throughout the case, over £820,000.

Mr Pullen was able to fund the 24/7 care he required at the nursing home where he wished to remain after the incident. He was also able to put an intensive rehabilitation package in place, through his case manager. The case manager co-ordinated an intensive rehabilitation package after David’s injuries.

Physiotherapy, pain management, psychological support were all put in place. An electric wheelchair, adapted vehicle and adaptations to David’s son’s house were also paid for to enable David to visit his family.

The Defendant initially offered a lump sum of £1.25m in settlement, which we rejected. However as Mr Pullen's care regime had been put in place through interim payments, we were able to demonstrate that this was the level of care he actually required for the rest of his life. This led to the case eventually being settled shortly before trial for the lump sum of £1.75 million plus periodical payments of £305,000 per annum to continue to fund Mr Pullen's care home and therapy fees. The periodical payment will also be updated in accordance with ASHE 3211 and 6115 so that all of David’s future case and case management needs are secured for the rest of his life.

The capitalised value of the award negotiated is in excess of £5 million.
