Expertise And Understanding From Irwin Mitchell

Repetitive strain injury (RSI) is a form of tendon injury that is closely related to a number of occupations, particularly those that require the use of computers or frequent repetition or a particular limb or body part.

For this reason, you could be entitled to make an RSI compensation claim if you have been diagnosed with repetitive strain injury as a result of either your current or a previous employment.

The term RSI is commonly used by doctors when:

  • Someone suffers pain that doesn’t indicate injury to a specific tendon, nerve, muscle or joint
  • The doctor nevertheless believes the problem is work related.

As imprecise as the diagnosis is, you know only too well how serious the pain can be.

If you have been diagnosed as suffering from repetitive strain injury as a result of your activity at work, you could be entitled to make a compensation claim for workplace RSI.

At Irwin Mitchell we fight fearlessly to achieve the best outcome for your RSI claim. We’re renowned for our understanding of the issues affecting you and your family due to a workplace injury, and we know what positive action to take to make a difference.

Our lawyers offer the highest level of professionalism and expertise, combined with dedication and sensitivity.

Above all, we put you first.

Handling Repetitive Strain Injury Compensation Claims With Expertise And Sensitivity

Whilst the public may use the term RSI to describe any injury to the upper limb caused by repeated stress at work, when a doctor diagnoses RSI it can often be because they don’t know the exact cause of your symptoms.

Common symptoms of repetitive strain injury include:

  • Painful and aching arms after use
  • A burning sensation
  • Weakness of grip
  • A sensation of seizing up in the forearm

These symptoms may be attributable to your work if it involves any of the following:

  • A high rate of repetition sustained over a long period
  • High or sustained force
  • Sustained bad posture

The problem of musculo-skeletal disease (the general term for back, muscle, tendon, joint and upper-limb disorders caused by work) is a priority for the Health & Safety Executive. Comprehensive guidance has been available to employers since 1990. There is no excuse for employers who ignore this but unfortunately many employers remain ignorant of the risks of repetitive strain injury at work.

Irwin Mitchell are aware of the pain and discomfort that RSI can cause, which is why we have a team of expert solicitors with specialist knowledge in RSI claims.

Machinist Secures Compensation For Carpal Tunnel Syndrome

Satinder Bains from the Birmingham office successfully concluded a claim for a client diagnosed with Carpal Tunnel Syndrome (CTS) affecting both the left and right hand. The claim concluded for the sum of £22,500 in compensation.

Mrs G aged 39 from Willenhall in the West Midlands worked as a machinist in a Factory producing metal castings. The work was heavy, repetitious and required machining heavy aluminium castings. The work would involve the use of an air gun to insert rivets into pipes, a drilling machine and working on a linishing machine.

Mrs G’s work was not rotated, nor was she allowed adequate breaks. She had little training for her job and no information about the possibility of the risk of developing any injury such as carpal tunnel syndrome.

Mrs G who has undergone surgery to relive her symptoms commented ‘The Company provided no medical assessments to their employees and would not rotate my work so that I was not constantly performing heavy physical work. My symptoms continue. I have now had three injections into my elbows and whilst these ease the symptoms that I experience, they never go away.’

Mrs G’s award was secured by Industrial Disease specialist Satinder Bains of the Workplace Illness team at the Birmingham office of national law firm Irwin Mitchell.

Commenting on the award Satinder Bains said “Carpal tunnel syndrome can be a particularly painful condition. Such an injury is particularly prevalent in machinists who perform forceful and repetitive work involving strong gripping forces and hand and wrist movements.

"This case highlights the importance of health and safety policies. Employers have a duty of care to their staff, which includes ensuring that where the work is repetitive and/or involves forceful movements a full risk assessment is carried out, proper training provided, the work should be rotated and work periods involving a lot repetition should be broken up with short frequent breaks. With proper precautions Mrs G’s injury could have been avoided”.
