Lack Of Training In Care Home Leads To Injury For Care Assistant

A 30 year old care assistant in a South Yorkshire nursing home suffered a severe injury to her shoulder as a result of lack of training been given in moving and handling patients. 
 
She was working with a colleague to transfer a resident from a wheelchair to a chair; however our client’s colleague had placed the wheelchair too far away to enable a slide transfer. As our client and her colleague transferred the resident, the resident’s legs buckled and our client’s colleague released the resident causing our client to take the resident’s full weight.
 
Our client suffered a soft tissue injury to her neck and shoulder and unfortunately developed a chronic pain syndrome. She has been unable to return to her work as a care assistant and her symptoms continue to interfere with her work choices.  Her social life has also been significantly affected and she is unable to return to running, something which she enjoyed previously.
 
Despite a continuing denial of liability, Irwin Mitchell’s specialist Personal Injury team were able to settle the case for £25,000 shortly before it was to be listed for trial. It is hoped the funds will allow our client to access recommended multi-disciplinary pain management to improve her symptoms.
 
This case shows the importance of adequate training and procedures being in place to prevent injury.
