Many jobs and workplaces require employees to work in environments where noise levels and patterns are potentially hazardous to your hearing. Employers have a responsibility to provide their employees with adequate protection against this noise. If this protection is missing or flawed, the result can be serious and long-lasting damage to hearing and can result in industrial deafness or noise induced hearing loss (NIHL).

Handling Hearing Loss Claims With Expertise And Sensitivity

If you’ve been exposed to excessive levels of noise in your employment which may have damaged your hearing, you may be entitled to make a hearing loss claim.

Due to the ageing process every person’s hearing deteriorates to a level that they may require the television turned up louder or miss parts of conversations when in a group of people. The general deterioration in hearing due to the ageing process is known as presbyacusis. However if you were exposed to excessive levels of noise in your employment this may have contributed to your hearing loss and you could be entitled to make a hearing loss claim.

Sound consists of vibrations of air in the form of waves. In the ear there are tiny cells called hair cells which move in response to the vibrations caused by noise. These vibrations are then converted into signals that are transmitted to the brain. In the brain, the signals are interpreted into language or music. The volume of sound is measured in decibels (dB) and when you are exposed to excessive levels of noise the tiny hair cells in your ear become damaged. If you experience this type of damage to your hearing as a result of being exposed to loud noises at work ,you may be entitled to make a claim for hearing loss compensation.

The severity of Industrial Deafness / Noise Induced Hearing Loss (NIHL) can vary depending on the length and level of exposure suffered by the individual. Any occupation with exposure to loud noises on a continuous day-to-day basis can result in hearing loss due to nerve damage. Some people are more susceptible than others to hearing loss.

To test if a person suffers from a hearing loss a hearing test known as audiometry will be undertaken. The audiometry tests the hearing over a series of noise frequencies from low pitched noise to high pitched noise and the results are plotted on a graph.

If you have previously been exposed to high levels of noise at work and you now find that you have to turn the volume on your television up or cannot follow a conversation where there is background noise, you may be suffering from industrial deafness or noise induced hearing loss.

Another effect of exposure to loud noise is Tinnitus which can sound like ringing, whistling, buzzing or humming in the ears or head. For those who are suffering from tinnitus as a result of exposure to loud noises at work, Irwin Mitchell may be able to help you make a claim for compensation.

Irwin Mitchell can help you with your industrial deafness claim, with a team of specialist solicitors who will explore your hearing loss case thoroughly. Whether you have suffered from tinnitus, acoustic shock or more severe forms of hearing problems, we can ensure that your industrial deafness compensation claim is handled compassionately and professionally.

The severity of industrial deafness or noise-induced hearing loss can vary depending on the length and level of exposure, but if you believe you’re suffering from this distressing condition, we can help you pursue a hearing loss claim.

Royal Doulton Worker Suffered Noise Induced Hearing Loss

Irwin Mitchell's Industrial Deafness Team has assisted a former worker of Royal Doulton to obtain a four figure sum for deafness caused by noise at work.

Mrs T worked at Royal Doulton for nine years, 8am – 5pm, five days a week, as a Kiln Emptier. Her role involved taking ware off after it had been through the kiln and placing it into boxes to go to another department.

The kiln was huge, about 50 yards long and the kiln dryer, which was no more than three feet away from Mrs T, ran continuously – even during break times.

Mrs T recalls that to talk to a friend four or five feet away they had to shout to one another and if any of the others at the other end of the kiln wanted to talk to her they would have to leave their work station and come right over.

Mrs T said: "Recently my grandchildren have told me the TV is on too loudly but I thought this was just part of getting older.

"In around September 2009 I went to my GP about my ears because if someone had their back to me, or if more than one person was talking then I couldn’t always make out what they were saying.

"I was referred to hospital; my hearing was tested and I was given hearing aids. No-one told me what had caused my hearing loss so I assumed it was normal and due to getting older.

"At the end of 2009 I saw an article in my local paper, the Sentinel. The article was about people who worked in the potteries and how the work damaged their hearing and I wondered, for the first time, whether my hearing problems were caused by my exposure to noise at work.

"As a result I called Irwin Mitchell about making a claim.”

Louise Scott, a solicitor in our Birmingham office said: "Anyone who has to take legal action as the victim of someone else’s negligence is entitled to good quality, independent legal advice and to recover and keep 100% of their compensation. I was pleased to be able to obtain a four figure sum for Mrs T.”
