Handling Acoustic Shock Claims With Expertise And Sensitivity

Acoustic shock is the common name for a short, high-pitch or high-intensity sound transmitted through a telephone or radio headset. There are often no identifiable causes for these sounds - but such sound-shocks mainly affect call handlers, causing:

  • Permanent damage to the hearing
  • Tinnitus
  • Hyperacusis  - increased sensitivity to sounds, often resulting in pain or discomfort from normally tolerable sounds.

There are various devices being brought into the market to protect against the "acoustic shocks" such as 'acoustic shock protection' and a 'headset noise limiter'.

The Health and Safety Executive has recently funded research to develop an in- line noise exposure monitor and acoustic shock limiter for headsets. Current advice to call centres from the HSE Revised Guidelines for Acoustic Shock October 2004 is that they should implement a traceable reporting system for headset users who may have been exposed to acoustic shock incidents. The following information should be reported:

  • Date and time of the incident
  • Details of the source of the exposure
  • Description of the noise
  • Duration of the exposure
  • Details of the headset and telephone equipment used
  • Whether the incident was electronically recorded (a copy should be kept for future reference)
  • Symptoms experienced by the operator directly related to the acoustic shock incident.

Call Handlers should be trained to recognise such incidents and how to report them. Employers have a duty under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR) to report certain types of work-related injuries, including those which result in a person being unable to carry out their normal work for more than three consecutive days, and those which result in admittance to hospital for more than 24 hours. Such reports should be made to the relevant enforcing authority.

Yorkshire Man Recovers Compensation Against Former Employers For Noise Related Deafness

A Yorkshire man has recently secured a four figure settlement for the hearing loss and tinnitus suffered as a result of exposure to loud noise at work.

Our client first worked for Birstall Carpets Limited as a Production Controller at their premises in Briar Mills in Leeds.  He worked there between 1971 and 1974 and was exposed to very loud noise from weaving machines.  He was never provided with hearing protection during his time working there.

He then worked for British Belting and Asbestos (BBA) between 1974 and 1978 at their premises in Cleckheaton, West Yorkshire.  The company made brake linings for vehicles at this site and our client operated noise press machines.  Again, this company did not provide him with hearing protection or warn him of the dangers posed by excess noise.

In 1978, our client moved to work for Harrison & Gardner at their factory at Victoria Dyeworks in Liversidge.  Our client worked with the company until 2002 and it was only in the mid 1990s that he was first provided with hearing protection, when the company gave him ear plugs. Our client operated noisy dye machines which were so loud he had to shout to make himself heard to colleagues close to him.

In recent years, our client developed hearing loss and tinnitus, which he describes as a permanent ringing sensation in his ears.  He initially thought these problems occurred naturally and may have been due to getting older. However, when he had a hearing test, he was informed that his problems could be due to his noise damage, so he instructed Irwin Mitchell to make a claim for compensation.

Mark Lennon, a Solicitor in the workplace injury team in Birmingham, who specialises in noise induced deafness cases, acted for the client and successfully secured a settlement on his behalf.

Mark Lennon said: “ As our client worked for three different employers in noisy jobs, we had to pursue claims against all of them as each period of noise exposure was held to have contributed to his hearing loss.  Fortunately we were able to locate details of the relevant insurers for each of the three employers.  After some negotiations with each of them, we were able to achieve full recovery of compensation from all the companies.”
