Six Figure Criminal Injuries Award For Shaken Baby Case

Irwin Mitchell has assisted a client to obtain compensation from the Criminal Injuries Compensation Authority (CICA). In excess of £640,000 has been awarded to a 19-year old boy who was shaken at birth by his father.

Our client suffered a severe brain injury when he was just five weeks old as a result of being violently shaken at home. He suffered a fractured skull and a broken leg and was diagnosed with hydrocephalus, or "water on the brain".

The injuries he suffered as a baby had a profound effect on his childhood development and, as he progressed through his teenage years, it became apparent that he would require care, support and security for the rest of his life. The cognitive difficulties arising from the hydrocephalus, predominantly being poor memory and concentration and lack of awareness and motivation, meant that he remains dependant on his family.

Sarah Brumpton, Associate Solicitor in Leeds’ specialist CICA team, compelled the Criminal Injuries Compensation Authority to award this "shaken baby" case a life-changing figure under their old scheme.

Our client recently appeared before the CICA panel in Manchester, who regularly award compensation to people who have been physically or mentally injured due to a violent crime, and was told that he was a most deserving candidate for the award.

The panel were delighted that the money will provide our client with the help and support he needs to obtain employment and to have a full and secure life.
