Man Receives Compensation For Psychological Damage

Our client has received more than £3 million in damages for the psychiatric injuries he sustained over three years as a child.

Our client was just a baby when he was subjected to physical, mental and sexual abuse by his family. He was taken into Local Authority care where he spent the remainder of his childhood. His behavioural difficulties were described as highly sexualised. As a result of his behaviour, adoption placements broke down and our client spent the remainder of his childhood in institutional environments. He self-harmed and was described as presenting in a very childlike and immature manner and would remain vulnerable to exploitation by others for the rest of his life.

He remains in institutional care, now residing in a home for adults with learning disabilities where he requires 24-hour supervision and support with daily activities. Experts identified that his cognitive and behavioural development were stunted as a result of his traumatic experiences and his quality of life as an adult was severely impeded by the events of his childhood.

Irwin Mitchell took on his case and pursued a claim to the  Criminal Injuries Compensation Authority (CICA). The CICA concluded that our client’s current and future needs for both care and psychological support would require substantial funds. They also considered that his traumatic experiences had a significant impact on his opportunities in life and that he would never be able to sustain remunerative employment. The sum of £3,012,293 was awarded in light of these issues.

Our client is working towards increased independence where he can live in the community but he will require a high degree of supervision for the rest of his life. The money he was awarded will allow him to receive private care and the therapy he needs to works to assist him psychologically.
