Expertise And Understanding From Irwin Mitchell

Whilst almost all sports and leisure activities involve some degree of risk, there are various parties who are responsible in law to protect our safety as much as possible and minimise the risk of sports related injury or harm occurring.

Both in the UK and abroad, clear, comprehensive health and safety systems should be employed and adhered to when sporting or leisure activities are taking place. If such health and safety systems breakdown the effects of a resulting sporting injury can be devastating and can potentially have long lasting consequences.

At Irwin Mitchell we fight fearlessly to achieve the best outcome for you following your sporting injury. We’re renowned for our understanding of the issues affecting you and your family sports accident abroad, and we know what positive action to take to make a difference.

Our lawyers offer the highest level of professionalism and expertise, combined with dedication and sensitivity.

Above all, we put you first.

Handling Your Sports Injury Claim With Expertise And Sensitivity

Whilst many of us accept that sporting activities carry some level of risk, health and safety regulations are in place to minimise that risk. If these standards have not been met and result in loss to you, then you could claim compensation for the injury sustained abroad.

Irwin Mitchell can help you to pursue a sports injury claim if you have suffered an injury during any form of sports or leisure activity whilst abroad. Such sporting activities could range from some form of organised beach sports, adventure activity, skiing or extreme sports through to casual activities, such as use of a hotel gym, tennis court or swimming pool.

In some cases it may be possible to make a claim against the UK tour operator if the incident occurred during your package holiday. In other cases, claims arising out of sporting or leisure activities may be made abroad - for example, against the company running the activity or against an individual who has caused the accident. With extensive experience in this area, we have recovered compensation in many cases arising out of sports and leisure accidents that have occurred abroad.

It is worth bearing in mind that pinpointing liability in international law can be complex and there can be strict limitation periods setting out how long you have to pursue your claim which varies from country to country, so we will be happy to offer free initial advice.

Irwin Mitchell are major UK specialists in pursuing individual actions for people who have suffered sporting injuries under a range of circumstances whilst abroad. We have also undertaken large group actions for people who have suffered injuries under the same circumstances.

Around The World Yacht Race Accident

In 2009, our client sustained injuries whilst participating in an ‘around the world race'. The yacht was moored in the French harbour of La Rochelle when our client was asked to help hoist the skipper from another yacht, up the main mast, so that the vessel could prepare for his departure to Rio De Janeiro the following day.

As our client boarded the yacht, he reached the top of the ladder and stepped directly into a hatch that had been left open, this caused him to double over and fracture the fibula in his left leg.

Our client was rushed to a French hospital where he underwent surgery to put a pin in his leg which was then cast. Because of his injuries, our client was forced to retire from his around the world venture. Following the accident, our client still suffers from symptoms resulting from the injury and is receiving medical care from an Orthopaedic surgeon and physiotherapist where he resides in Australia.

Irwin Mitchell managed the compensation claim against race organiser, Clipper Ventures PLC, a UK based company. We alleged that had the novice sailors been provided with adequate training in advance of the race, the hatch would not have been left open, resulting in our clients’ injuries. Clipper Ventures PLC have admitted primary liability, we are currently obtaining further medical evidence in order to pursue the claim further.

Irwin Mitchell’s International Travel Litigation Group specialises in recovering damages for people who have sustained an injury abroad. If you have suffered an injury whilst abroad, we would like to help you achieve the compensation that you may be entitled to.
