Expertise And Understanding From Irwin Mitchell

Holidays are an important time for all of us – a time for us to relax and recuperate. If you suffer illness whilst on holiday abroad, it can not only ruin your holiday, but may even cause lasting damage to your health.

If you’ve suffered an illness on holiday then you could make a claim for compensation.

At Irwin Mitchell our lawyers fight fearlessly to achieve the best outcome for your claim. We’re renowned for our understanding of the issues affecting you and your family due to an illness abroad, and we know what positive action to take to make a difference.

Our lawyers offer the highest level of professionalism and expertise, combined with dedication and sensitivity.

Above all, we put you first.

Handling Illness Abroad Claims With Expertise And Sensitivity

If you have been unlucky enough to suffer illness abroad, whether in a hotel, on a cruise-ship or in other circumstances, you may well be able to apply for compensation or damages.

Here at Irwin Mitchell, we act for individuals – and groups of clients - who have suffered an illness (including salmonella and other types of food poisoning) on holiday. Our clients range from individual families to groups of 1,000 clients or more who make holiday complaints resulting from illness abroad. Many people may be entitled to receive compensation for damages or losses sustained as a result of the holiday illness.

Just because your illness occurred abroad, you do not always have to make a claim in that country. If you have suffered illness in a hotel as part of a package holiday then it may be possible, depending on the circumstances, to bring a claim in the UK Courts against the Tour Operator. In other cases, claims may be made abroad, for example against the hotel.

Irwin Mitchell is the UK's leading firm of solicitors in travel litigation. We have an enviable reputation for pursuing group actions and individual claims for people who have suffered illness abroad.

As well as a team of specialist English holiday illness lawyers who are well equipped to handle holiday complaints, we also have several Spanish, French, German and other foreign lawyers who are able to provide specialist advice on foreign law issues.

Teenager Left With Post Traumatic Stress Disorder After Holiday Hell

Travel Law specialist Irwin Mitchell have again been asked to help following reports of illness at the Four Star St George Three Corners Resort in Sharm El Sheikh, Egypt.

The furious family of a 16-year-old girl have spoken of their ordeal in a bid to protect future holidaymakers from suffering as they have. The girl was left with Post Traumatic Stress Disorder after the hellish holiday that left her dreams of starting college in tatters.

Sophie Hopper, 16 had been looking forward to starting college this September but she became so ill on the disastrous family holiday to the four-star resort that she now constantly feels anxious and terrified of becoming ill again.

The teenager visited the resort with her parents Dominic, 40, and Donna, 41, and siblings Nathan, 19, and Paige, 11, along with her uncle, Auntie and Cousin, in August of this year.

Of the eight family members, seven fell extremely ill within days of arriving at the hotel and four of the party remain ill to this day. Both families recall that there were other guests who were suffering with similar symptoms at the hotel. They have now turned to international travel law experts at Irwin Mitchell for help.

The firm has taken legal action against the hotel successfully for a number of clients previously.  One of those earlier guests who suffered illness was diagnosed as suffering from Giardia, a serious gastric illness. The firm secured an admission of liability and an out-of-court settlement of several thousand Pounds.

The Hopper family experienced diarrhoea, severe stomach cramps, nausea, vomiting and a loss of appetite. The family, who have visited the resort for the past two summers, have put their suffering down to poor hygiene standards including food being left uncovered and swarming with flies. As well as filthy hotel conditions including dirty toilets and washbasins, at one point Lisa found a snail in a bunch of grapes from the hotel’s buffet.

Rajbir Somel, travel law specialist at Irwin Mitchell, said: “The two families were looking forward to an enjoyable holiday together. Instead, with the exception of Donna, the entire party fell very ill. Having stayed at the hotel in 2009 and 2010 both families had a certain level of expectation but were completely shocked when they arrived at the hotel to see how badly standards had slipped. As standards appear to have plummeted so dramatically it’s extremely likely that other British holidaymakers will have been affected whilst staying at the St George Three Corners Resort this year.”

Rajbir added: “The whole group has been left devastated – especially Sophie. Not only was their dream family holiday completely ruined by illness, they are still suffering the repercussions to this day, with illness for the family still ongoing. Sophie is now seeing a counsellor and sadly has been unable to start college, which she was very excited about.

“The entire experience is completely unacceptable and we just hope that Thomas Cook will work with us to ensure that Sophie receives the best treatment possible and so the two families can put this truly awful experience behind them.”

Donna said: “The conditions at the hotel were absolutely dreadful – I couldn’t believe how it changed. I was absolutely shattered to see all my family so unwell.

“Sophie has lost a stone in weight and has been told by her doctor that she’s suffering with Post Traumatic Stress Disorder and is now seeing a counsellor. She’s in a terrible state and I cannot bear to see her like this.

“I cannot believe that a company like Thomas Cook would treat its customers in such an appalling manner and our daughter has been left so distressed by the whole experience. We want answers explaining how this was able to happen and reassurances that standards at the hotel will be hugely improved.”
