Head Injury Solicitors Secure £800,000 Compensation for Ten Year Old Girl

Head injury solicitors, Philip Edwards and Wendy Nixson of Irwin Mitchell, acted on behalf of a young female client who was injured at the age of 10. She sustained a severe head injury requiring neurosurgery as a result of a road traffic collision.

Our client had learning difficulties and travelled to her school, providing special educational needs, by bus on a daily basis. The instructions to the driver of the bus were to ensure safety by accompanying her across the road and seeing her to the front door of her house at the end of each day. The driver of the school bus neglected to do this and as a result, our client was hit by a car as she crossed the road to her home.

The claim had been handled by another firm of solicitors with no experience of acquired brain injury and they had agreed a settlement with the bus driver’s insurers for £20,000. Due to our client’s age at the time, the matter had to be approved by the Court. The Judge at the hearing would not approve the settlement due to the severity of injury which she had suffered.

The matter was then transferred to Irwin Mitchell and a team of highly qualified head injury solicitors were instructed to assess our client in order to properly determine the extent of the damage to the brain caused by the collision and to consider the difference between her capabilities before and following the accident, both at the present time and into the future.

As a result of this expert evidence, our legal team were able to settle the claim following a meeting with the insurers for £800,000. This time the Judge felt much happier about approving the settlement.
