Case Study 1

Experienced cyclist Mark bought a new bike and had only used it to travel short distances before his accident. He was riding downhill at approximately 30mph when he heard a knocking noise from the front end of the bicycle and felt a vibration. Suddenly, the wheel buckled and Mark was thrown over the handlebars, fracturing his collarbone.

With our help, Mark made a claim against the shop and the manufacturer of the bicycle. Both denied that something had occurred to the spoke tensioning during assembly or servicing which made the wheel buckle. However, we were able to support the theory with expert evidence, Mark won his case and he was awarded £10,500 in damages.

Case Study 2

Irwin Mitchell represents a number of people who developed a fungal eye infection after using ReNu MoistureLoc, a contact lens solution which wasn’t properly tested before it was put on the market.

Manufacturers Bausch & Lomb recalled the solution following reports of fusarium keratitis eye infections in a number of people that used the product.

Fusarium keratitis infects the cornea, causing pain, discomfort, light sensitivity, and loss of vision. Treatment involves expensive antifungal drug therapy and, should the drugs fail, surgery must be performed to remove any ulcers, lesions, or other unhealthy growths.

At the time of the recall, 2.3 million people worldwide used the contact lens solution, oblivious to the potential dangers.

Case Study 3

In June 2006, the Food Standards Agency forced Cadbury’s to withdraw a million chocolate bars from shops after salmonella montevideo contamination was identified at one of its factories. The Health Protection Agency identified 42 people who had been infected and Cadbury’s were fined £1 million.

Irwin Mitchell represented three families whose children suffered sickness and diarrhoea after eating the contaminated chocolate. Two of the children received over £800, whilst the third received £2,020 as their injuries were more substantial.

Stockport Woman Seeks Help After Being Fitted With Faulty Hip Replacement

Lawyers from Irwin Mitchell’s Defective Products team are currently working on behalf of Sally Gration, who has suffered numerous problems caused by a faulty metal on metal hip replacement.

Sally, 57, a nursery teacher from Stockport, was born with Dysplasia in her right hip. In February 2006 she underwent an operation to resurface this hip and was fitted with a De Puy ASR hip implant.

At first Sally’s recovery seemed to be going well and the pain she had been suffering from her right hip was much better. However by the summer of 2007 she started to experience problems, beginning with a partial dislocation in June.

By 2009 Sally was experiencing twinges and aching in the hip and couldn’t walk far without experiencing considerable pain. She put this down to the normal consequences of having had hip surgery.

In January 2011, Sally received a letter from the hospital telling her that the hip implant was being recalled. She went to hospital for x-rays and blood tests. While waiting for the results of the tests, Sally continued to suffer dislocations and twice needed to undergo general anaesthetic to reunite the hip joint.

In March 2011 Sally was told that she had high levels of chromium and cobalt in her blood and that she would need to have revision surgery on the hip.

Sally had revision surgery in May 2011 but it became clear during surgery that there was not enough pelvic bone remaining for a new prosthesis to be fitted to. The surgery was not completed and Sally left theatre with no right hip joint.

Two weeks later, Sally left hospital without a hip. She was confined to a bed in her living room while she waited for a surgeon to be found who could fit her with a new implant.

Sally’s care was transferred to Professor Ian Stockley in Sheffield. In November 2011 he fitted her with a new ceramic implant. Hopefully this surgery has put Sally on the road to recovery but only time will tell us how she will be in the future.

As a highly experienced nursery teacher who is passionate about her job, Sally is conscious about the amount of time that she has had to take away from work. Also, Sally’s lack of mobility means she has put on the weight she successfully lost over previous years having had to relinquish her gym membership due to the problems that she had suffered.

Sally’s husband has had to provide her with round-the-clock care and her life has been significantly affected by the problems with her hip replacement.
