A Law Firm For Life
Disputing a will is never the nicest thing to have to think about and deal with, especially when it comes to issues of testamentary capacity. Establishing that someone was of sound mind to make a will and claims where capacity is an issue are frequent and Irwin Mitchell can help you.
Experts In Testamentary Capacity Claims
In order for a will to be valid, the person making the will must have what is called Testamentary Capacity.
The person making the Will must be capable of understanding:
- That he or she is making a Will and the nature and effect of making a Will
- (In a broad sense) what assets are to be disposed of by the Will
- The claims of those who might expect to benefit from the testator’s will (both those being included in and being excluded from the will)
The person making the Will must not have any delusion which influences or is capable of influencing the provisions of his will.
All elements of the test must be satisfied. If they are not satisfied there is a risk that the will may be found to be invalid.
