In a will dispute where, following a testator's death, a Will which was known to have existed cannot be found, it is presumed to have been destroyed by the testator with the intention of revoking the Will. In such a case, the burden of proving the existence and non-revocation of the lost Will falls on the person seeking to have the missing Will proved.
Where an original Will has been lost, mislaid, destroyed or is not available, an application may be made for an Order admitting it to Probate subject to proof contained in a copy, a completed draft, or set out in other evidence of its contents. The application is made by sworn statement. The Judge or Registrar may require that notice be given to any person who is prejudiced by proof of the Will, which often gives rise to a dispute.
