Sometimes, it is not clear from a will what the person making it was trying to achieve. Where it is not clear from a will what the person making it was trying to achieve, it will ultimately be for a court to determine what the will means. The court will look to try and interpret the will.  Statutory Rules and case law has evolved over time which guides the court in this process.

Where the words of the will are clear then the court will ordinarily put those words into effect, even though the result may not be what it is believed the testator intended.

Only if it is not possible to establish the meaning of a will from its wording will the court look at evidence external to the will to try and work out what was intended by the testator.

In certain circumstances, where there is clear evidence, the court may be able to correct the terms of a Will.
