A Law Firm For Life

The death of a loved one and the subsequent responsibility of dealing with estate administration and probate can be very difficult indeed.

Irwin Mitchell’s specialist team can give advice and support on dealing with an estate, or acting as an executor or administrator. We will aim to make the experience as stress-free as possible.

Experts In Estate Administration

In order to collect assets, sell property and wind up an estate, you will usually need to obtain a ‘Grant of Probate’ from court. The Grant of Probate confirms that the person appointed in the Will (the Executor) or if there is no Will, the Administrator, has the authority to deal with the deceased’s estate.

Irwin Mitchell has three levels of service available which provide the level of advice you need rather than a one size fits all approach.

Our entry level service, Probate, is designed to assist you with the application for the Grant of Probate from the Court and the completion of the appropriate Inheritance Tax forms. Irwin Mitchell has streamlined processes which mean we can offer you an efficient service at a highly competitive rate, leaving you to deal with the rest of the administration yourself.

Probate Plus is designed with flexibility in mind. It includes obtaining the Grant of Probate on your behalf and any additional services which you may require assistance with such as the sale of property, completion of Inheritance Tax forms, sale of shares and tracing beneficiaries. Our menu based options mean you can select the right level of support and one of our team of experts will be happy to chat through the options with you in more detail to make sure you get the help you need.

Probate Premium is the full end to end service which means we will deal with every aspect of the estate administration from obtaining the Grant to winding up the estate and making the final distributions to beneficiaries. Ideal if you want the reassurance that everything in the estate is being dealt with in a timely and professional manner.

Our highly experienced team is available to answer any questions you may have on the process and advise you on what to do next. Contact us and we will provide initial advice with no obligation.

We have a sensitive and understanding approach and if you choose to instruct us we will give you a dedicated point of contact to support you through what can be a very difficult time.

Second Will Set Aside After Contesting Mental Capacity

Contesting Mental Capacity

Our clients were relatives and charities who had been named as beneficiaries in a will made by an elderly lady.  When she died they discovered that she had apparently made a later will which conferred a substantial benefit on her housekeeper/carer.  The will had been made without the knowledge of the lady's other regular visitors, was prepared by a firm of will writers whose visits were arranged by the housekeeper and without obtaining specific confirmation of the lady's mental state from her doctor.  The clients' claim to have the will set aside on the ground that it was made at a time when the lady no longer had testamentary capacity was successful.
