Our clients were relatives and charities who had been named as beneficiaries in a will made by an elderly lady.  When she died they discovered that she had apparently made a later will which conferred a substantial benefit on her housekeeper/carer.  The will had been made without the knowledge of the lady's other regular visitors, was prepared by a firm of will writers whose visits were arranged by the housekeeper and without obtaining specific confirmation of the lady's mental state from her doctor.  The clients' claim to have the will set aside on the ground that it was made at a time when the lady no longer had testamentary capacity was successful.
