Man Receives Compensation in Action for Police Negligence

Mr A had the day to day responsibility for running an Indymedia website.

In June 2005 an article was published which was subsequently taken off.

British Transport Police contacted our client requesting the computer equipment and the IP address that made the posting on the website.

Mr A was arrested and held in custody whilst the police executed a search warrant and equipment and the server was taken.

No charges were ever brought against our client.

The case against British Transport Police involved the arrest and taking of the equipment.

The Indymedia website as an organisation is committed to freedom of speech and was in no way able to obtain IP addresses from their servers.

Irwin Mitchell argued that our client had committed no wrongdoing and the case was settled out of court with damages being paid.
