Loss of mental capacity can be a terrifying prospect. it is vital that individuals plan well in advance and receive proper advice.

Advice For Attorneys & Deputies

The role of an attorney or deputy is onerous and subject to many restrictions with the attorney or deputy held personally liable for losses incurred. We support attorneys and deputies in their roles by helping them to understand their duties and when their decisions are questioned by others.

Incapable individuals' estates can often be poorly structured in terms of tax efficiency. Our specialist private wealth solicitors can help attorneys and deputies by reviewing estates to determine if restructuring is appropriate to protect assets and/or mitigate tax.

Attorneys and deputies have very limited power to undertake tax and estate planning. We can assist by applying to the Court of Protection for permission to enable them to make gifts to or payments on behalf of family members and friends as part of wider estate planning.

To protect attorneys and deputies we also:
