What is Probate?
In general terms, probate is the name given to administering the estate of someone who has recently passed away.
If that person wrote a Will then the ‘executors’ named in the document will be in charge of distributing the person’s belongings. Depending on the value of the estate, the executor may need to apply to the probate court for a “grant of probate” that gives them legal permission to administer the estate.
If no Will was written, then a close relative can apply to deal with the estate. Entitled relatives can apply to court for a ‘grant of letters of administration’ which, when issued, confirms them as the rightful ‘administrator’. In certain cases, more than one administrator will be required.
