Asbestos-Related Disease Claims Guide

Can I Claim Compensation For Pleural Plaques?

Pleural plaques are distinct patches of scar tissue that form on the lung membrane (pleura). Although symptomless, they are a sign that you’ve been exposed to asbestos at some point, usually appearing between 20 to 30 years after the exposure.

The pleural plaques themselves won’t develop into more serious condition but, as they’re caused by asbestos exposure, you could be at greater risk of developing another asbestos-related disease.

Claiming Compensation For Pleural Plaques In Scotland

Unfortunately, you can only claim compensation if you’ve developed pleural plaques after coming into contact with asbestos in Scotland, not England or Wales. This is because the House of Lords decided in 2011 that the symptomless nature of pleural plaques meant that it wasn’t a condition eligible for compensation. The Scottish Parliament overturned this decision, ruling that pleural plaque claims could still be made when the exposure to asbestos had happened in Scotland.

Our Glasgow office can investigate your case, working out how the exposure happened and what could have been done to prevent it. You don’t have to be a current resident of Scotland in order to make a claim.

Despite there being no symptoms associated with pleural plaques, the fact that they’re evidence of asbestos exposure means that you may feel great anxiety about what the future holds. If your exposure to asbestos was in Scotland, we can help you claim compensation for this emotional distress.
