Abduction To A Hague Convention Or Brussels II Country

When a child under 16 has been taken to a country that is a signatory to the Brussels II regulation or The 1980 Hague Convention on child abduction, they will be returned if a legal application is made within a year and none of the limited defences can be established. 

Under Brussels II, the aim is for a decision to be made within six weeks of the application. We can also ask the English courts to review the decision if a foreign court does not order the return of the child to the UK. The abducted child will then be returned if the English court decides that it is in the best interest of the child that they should be.

Applications under these agreements are initially made to the relevant Central Authority each signatory country will have. We can assist you with locating the relevant authority and in preparing your application or any supporting evidence they may need.

Abduction To A Non-Hague Convention Or Brussels II Country

If a child is taken to a country that isn’t signed up to the Hague Convention or Brussels II revised legislation, the procedure is more complex as laws vary from country to country. In these instances our specialist team will help you in finding an experienced child abduction lawyer in the relevant country to help you fight for the child’s return.

Some countries such as Egypt and Pakistan have bi-lateral protocols in place that set out the considerations that apply in child abduction cases, making judicial co-operation between the two countries much easier.
