Kevin is National Head of Regulatory and Criminal Investigations, specialising in advising businesses, their stakeholders and managers in all aspects of investigation by front line regulators into commercial activity. He defends any prosecutions which may arise from those investigations.
Kevin’s areas of expertise include:
- SFO investigations and prosecutions. Kevin has acted in most of the major SFO cases of the last 15 years including Aveling Barford Pension Fund, Hinchliffe/Fascia, CWS/Regan, IKEA, Anglo American, Generic Drugs Cartel, GPNT Trustees and others
- Bribery and Corruption. Kevin has been involved in most of the major corruption cases, both domestic and foreign, including CWS/Regan, Jubilee Line Extension, Balfour Beatty, BAE, Mabey and Johnson and is currently instructed in a number corruption investigations in Africa and Asia. Kevin lectures extensively on the Bribery Act and has assisted a number of companies with their Bribery Act compliance. He is the Chairman of the International Bar Association Working Group on the Bribery Act.
- Competition issues, particularly those arising from the Enterprise Act 2002. Kevin acted in the successful defence of a British Airways Director in the OFT prosecution for price fixing with Virgin Atlantic Airways. He has advised on competition law issues, including immunity and leniency, in a number of market sectors and is advising in the OFT investigation into the heavy truck industry. He acted for the lead defendant in the successful defence of a prosecution for price fixing in the generic drug industry.
- FSA issues. Kevin advises on both regulatory compliance issues, including responses to investigations and also criminal prosecutions brought by the FSA. Amongst other cases he acted in the Split Capitals investigation and is acting in the Blue Index insider dealing prosecution, the largest value insider dealing case ever brought.
