Samantha Ewing

I specialise in resolving disputes relating to wills, trusts and probate.  This includes challenges against the validity of a will through fraud, lack of capacity, undue influence or lack of knowledge and approval of the contents of the will.  I advise potential beneficiaries, current beneficiaries and executors on claims under the Inheritance (Provision for Family and Dependants) Act 1975.

I advise on and prepare Court of Protection applications relating to Statutory Wills, investigations into allegations of misappropriated funds from someone’s assets and dealing with reviews and appeals over failed Continuing Healthcare Funding applications.

I assist trustees and executors in disputes over the administration of a trust or estate (including disagreements between executors and/ or between beneficiaries and the executors).  I advise clients on professional negligence claims where a will has been incorrectly drafted or a delay has led to it not being executed in time prior to death.
