Richard has extensive experience of real estate disputes and advisory work. His focus is primarily on commercial landlord and tenant and other commercial property issues, positioning clients for the possibility of litigation whilst seeking solutions to avoid it. He is also a CEDR accredited commercial mediator.

Recent highlights

  • Advising national leisure centre operator in dispute with landlord over the landlord’s failure to carry out business critical repairs
  • Acting for UK subsidiary of US conglomerate in contesting guarantee claims under an old lease of property disposed of by the original tenant 20 years ago
  • Represented retail park anchor tenant on breaches by landlord of non-compete covenants by letting neighbouring premises to a competing business, culminating in the early departure of that tenant
  • Represented national charity in proceedings for specific performance of agreement to sell a £multimillion site to a developer where a neighbour sought after contract to register prescriptive rights over part of the property. Settlement achieved with neighbour and then with developer after mediation and property sale completed against a tight timetable
  • Represented UK subsidiary of Swiss manufacturing group in full recovery of UK dilapidations costs incurred by a tenant in administration via time limited and highly conditional guarantees provided by foreign based banks.
