Iain specialises in intellectual property with a particular focus on brand protection and enforcement.  He regularly advises clients on trade marks, designs and copyright (both contentious and non-contentious) as well as day to day managing of their trade mark portfolios. He also helps businesses with exploitation of their IP and has expertise in drafting commercial IP agreements (franchising, licensing and transfers).

Iain spent 6 years in-house with a multinational pharmaceutical company where he developed significant experience in  managing a large global trade mark portfolio and anti-counterfeiting strategies.

    Amazon Go Trade Mark Registered In The UK

    "While a new trade mark application is a strong indication that they intend to move into the territory at some stage, it is good practice for a business to file its trade marks in the key territories that they want protection in, even if they do not have immediate plans to launch. This is to ensure that they get the earliest possible filing date and establish trade mark rights long before others could come in and block the registration before them. "UK and EU trade mark law allows a trade mark to be filed on a intent to use basis and the Applicant has a period of 5 years from the date of registration to commence use before the mark becomes vulnerable to cancellation. So while Amazon could be planning to launch Amazon Go in the UK next year, they could just as easily be looking at launch in 2020-21."
