Expert Travel Lawyers At Irwin Mitchell Investigating Family’s Illness At Condesa De La Bahia

A family of three whose holiday to Majorca to celebrate a 50th birthday was ‘ruined’ by illness has instructed expert travel lawyers at Irwin Mitchell to investigate the cause of their illness.

Nigel Clement, 50, his wife Alison, 45, and their son Oliver, 6, travelled to the four-star Condesa De La Bahia in October 2015, which they booked through TUI UK Limited, trading as Thomson Holidays, to celebrate Nigel’s 50th birthday.

However, after their first night at the hotel, they found their bed to be too uncomfortable and asked to be upgraded to a suite. 

Despite their upgrade, the family reported that the shower cubicle in their bathroom was blocked and kept flooding causing, a pungent sewage smell in the room. They told their legal team at Irwin Mitchell that they were very disappointed in the quality of their room and the facilities offered at the hotel, such as the restaurants.

Just a few days into the trip Nigel and Alison, from West Sussex, began suffering with diarrhoea and vomiting. Oliver began suffering with the same symptoms shortly afterwards.

Nigel was forced to spend the best part of two days of their week-long break in his hotel room due to the severity of his symptoms. He missed out on spending quality time with his family on what was supposed to be a special holiday for him as he was celebrating his 50th birthday. 

They family told their legal team that the food at the restaurant was occasionally recycled at different meal times, chicken dishes were sometimes undercooked, that they saw mould and dirt around the pool area and that on one occasion the fire exit in the children’s disco room was padlocked shut.

Nigel raised these complaints to staff members at the hotel and the Thomson representatives but he felt that he was met with a lack of concern.

“Some of the reports we have heard from Nigel about the quality of the facilities at the hotel and the hygiene practices in place are concerning.

“Clearly, Nigel and his family, who booked the holiday to celebrate a significant milestone, feel angry and disappointed by their experience and want answers about what caused them to fall ill.

“Through our work we understand just how serious gastric illnesses can be and how much of an impact they can have on the enjoyment of a holiday and the long-term health complications some victims can suffer.

“We have now commenced our own investigations into the problems Nigel and his family suffered and we would ask anyone else who stayed at the resort at the same time, who may have suffered with similar problems, to get in touch as they may be able to help with our investigations.”

Nigel, a sales manager, said: “We have been travelling with TUI for some 25 years but unfortunately after booking this week-long holiday to celebrate my 50th birthday and my son’s 6th birthday, we’ve been left extremely disappointed and completely let down.

“The hotel was simply not what we expected of a luxury 4 star hotel and we feel that our complaints have not been taken seriously by TUI at the time. We would like answers about the problems we suffered and hope that by taking legal action we will achieve this.”
