Specialist Lawyers At Irwin Mitchell Secure Settlement For Birmingham Woman
An elderly pedestrian who suffered injuries after falling into the road after losing her balance on a pothole has received a £2,500 settlement from Birmingham City Council.
Shamin Bibi was walking along the carriageway which formed part of School Road in the Hall Green area of the city in February 2012 when she lost her footing and fell as a result of a pothole, suffering injuries to her right shoulder and knee causing acute symptoms which affected her significantly for the next four to six weeks.
The 70-year-old instructed specialist personal injury lawyers at Irwin Mitchell to investigate the firm has now secured her the four-figure settlement to fund treatment after the Council admitted breaching its duty of care.
Mrs Bibi explained to lawyers that in the weeks following the accident she required assistance with day-to-day tasks and help complete household chores.
She said: “I had just got off the bus and was walking along the street when I suddenly tripped and fell to the floor. I felt a lot of pain down my right side; in my shoulder and my knee and knew straight away that there was a problem.
“For the next few weeks I continued to experience pain and struggled with everyday chores which I had to get help to complete – it was a really difficult time for me.
“I’m pleased that the legal action is now over so I can move forward with my life.”
Specialist personal injury lawyer, Katy Bailey, representing Mrs Bibi, said: “Our client experienced a variety of problems because of this incident.
“Local authorities have a duty to maintain roads and footpaths to protect the safety of the public.
“We are glad that Mrs Bibi has now received justice after suffering injuries that could have been prevented.”
