Disappointment Following Cosmetic Surgeon’s Appeal Over Suspension

Legal experts representing a woman left scarred following cosmetic surgery arranged by Dr Ashish Dutta have revealed their disappointment after he launched an appeal against a tribunal decision to suspend him for 12 months.

The surgeon is going to the High Court to challenge the decision made by the General Medical Council’s Medical Practitioners Tribunal Service earlier this year, in which the organisation said his actions amounted to “serious professional misconduct” and that he represented “a risk to patients”.

Medical negligence lawyers at Irwin Mitchell’s Newcastle represent Andrea Scott, who suffered serious problems including scarring and stitching bursting open after the breast augmentation surgery arranged by Dr Dutta in January 2010 at the city’s Aesthetic Beauty Centre. Concerns were also raised regarding Dr Duttas aftercare following his failure to adequately deal with post operative infection. 

Angela Kirtley, the Partner at Irwin Mitchell who is acting for Mrs Scott in her legal action to gain answers and justice over her ordeal, said: “We are disappointed with the news that Dr Dutta has chosen to appeal the decision handed down at the tribunal into his actions, particularly as he originally suggested he would accept their decision.

“Since Andrea approached us with details of the problems she faced we have heard first-hand a number of concerns about his work which were subsequently raised in the tribunal hearing and ultimately led to his suspension.

“The safety of patients should always come first, so we will be watching events related to the appeal closely.”
