Irwin Mitchell’s International Personal Injury team has secured a four-figure settlement for a family who suffered severe gastric illness after staying at the Magic Hotel in Greece, during August 2011.
Zehra Isik, from Manchester, travelled to the resort with her four children for their first family holiday. However, just days into their two week stay, Zehra and her children began to suffer from severe gastric illness, with symptoms including diarrhoea, vomiting and stomach pains.
Our client raised a number of concerns relating to standards at the hotel including: rooms not being cleaned regularly, food often being left uncovered throughout the day, hand sanitisers not being available for guests and meals often being served lukewarm.
Tour operator Jetline Limited initially denied responsibility for our clients’ illnesses so the family contacted our specialist travel lawyers for help. Jetline claimed that the family’s stay at the resort was not a package holiday and therefore they could not be claimed against. However, after our experts presented evidence, the operator accepted that a package holiday was sold to the Isik family and an out of court settlement was agreed.
In relation to the case, international personal injury expert Clare Comiskey, said: “The illness suffered by the Isik family and their reports on the conditions and hygiene practices in place at the Magic Hotel were very concerning.
“It is disappointing that Jetline took so long to admit that the holiday was a package holiday but we are delighted to have been able to bow secure a settlement to cover Zehra and her children’s ruined holiday so they can put this terrible experience behind them.”
Zehra added: “The illness we suffered was terrible and we spend days in our hotel rooms as a result of the symptoms, so we weren’t able to enjoy the facilities.
“We are really pleased that a settlement has been achieved for us. We can now move on with our lives and put this experience behind us.”
