Irwin Mitchell’s serious injury solicitors secured a £1 million compensation award for a man who suffered a brain injury in a road traffic collision in January 2011.
In November 2012, our client contacted the Serious Injury team to enquire about transferring his case from his current solicitors. We were happy to help, organised everything to transfer the file and, after 18 months of hard work, the client has accepted a compensation award of £1m.
‘Little had been done’
When Irwin Mitchell took over the case there were six different defendants who all denied blame for the accident. Little had been done to try and progress the case to get rehabilitation for our client and he felt that he was never updated. He had to constantly chase his solicitor for an update.
Quickly after taking over the case, serious injury specialist Stacy Clements reduced the number of defendants to two. With both defendants continuing to deny liability, she obtained extensive evidence to take the case to trial at the beginning of July this year.
£1m compensation award
After exchanging evidence, and six weeks before trial was due to commence, the defendants requested a joint settlement meeting and it was here (after several hours of negotiations) that our client happily accepted a £1m compensation award.
Throughout the whole process, we’ve regularly updated our client. As a result, he was happy to attend the joint settlement meeting safe in the knowledge that he would be able to make an informed decision about any settlement offers.
Following settlement, he said: “After a very unsuccessful time with a previous solicitor I can honestly say that, for the relatively small amount of time that Stacy has handled my case, it has been life changing. Purely down to Stacy's professionalism, understanding and down to earth nature am I now able to attempt to live a life as close as possible to pre-injury.
“Her subject matter knowledge in brain injury and legal proceedings is seemingly endless. This coupled with a caring and kind hearted attitude made me feel extremely comfortable at every stage. Moreover this allowed me to trust the advice provided by herself and her associates.
‘Above and beyond’
“Stacy goes above and beyond to ensure her clients understand procedures and to ultimately reach a goal that's of every benefit to the injured. She’s sympathetic to not only the client, but everyone included. She is clearly passionate about her career and her dedication to my case alone should be admired.”
Commenting on the case, Stacy said: “Sadly, it is not uncommon for people to instruct solicitors who simply do not have the knowledge and expertise to handle a complex case such as this.
“Fortunately on this occasion we were contacted at an early stage which meant we could get the necessary evidence and secure the right settlement for our client and his family.”
