Six Million Compensation Sum Secured For Man With Severe Brain Injury

Through the hard work of John Davis, one of the specialist solicitors from Irwin Mitchell’s Newcastle office, we were able to secure a £6 million sum in compensation for a young man who suffered a severe brain injury in an accident at work in 2009.

Our client, PJ, was working on a building site when a chimney stack collapsed on him, leaving him with multiple serious injuries.

PJ sustained a severe brain injury as well as an almost complete traumatic amputation of his left knee.  He also sustained a fractured hip, right leg, pelvis and a scrotal crush injury. His left leg was also subsequently amputated below the knee.
As a result of his injuries, PJ’s personality changed dramatically. He became demanding, aggressive and difficult to support. He had restricted mobility needs as well as significant cognitive impairments with his memory, mood and temperament. When Irwin Mitchell took over the case from previous solicitors, PJ’s mother was his main carer and the burden which had been placed on her was exhausting.

How Irwin Mitchell Helped

PJ required significant support, as well as an intensive rehabilitation programme aimed at improving his quality of life and regaining physical strength. John Davis and his team managed to secure PJ several interim payments throughout the litigation, totalling over £750,000.

This allowed PJ to instruct a specialist brain injury case manager and to recruit a team of support workers to support him, therefore easing the burden of care placed on his mother. The interim payments also allowed PJ to undergo a tailored rehabilitation package, which included attending a specialist prosthetics clinic and being fitted with a prosthetic left lower leg.
The Newcastle team managed to secure a settlement of £6,000,000 to fund PJ’s future care and therapy needs, as well as providing him with the funds to move into more suitable accommodation.

The settlement was carefully calculated to take into account any deterioration in PJ’s condition, which was likely to occur in the future as well as reducing the reliance which had been placed upon his family.
