Compensation For A Motorcyclist After A Collision With A Farm Vehicle

Irwin Mitchell’s specialist Serious Injury team has helped a man claim compensation after he suffered a devastating spinal cord injury in a motorbike accident.

Background

In 2011, our client was out riding near Atcham, Shropshire. As he was approaching a slow moving farm vehicle, he decided to overtake. Unfortunately, at the same time the driver of the farm vehicle did not see our client and decided to turn right and our client collided into the side of the farm vehicle. Although the collision was at a relatively slow speed, our client was thrown from his bike and unfortunately suffered a spinal cord injury.

The injury left him with complete paraplegia, meaning he has no movement or sensation in his lower limbs and has to use a wheelchair.

How Irwin Mitchell Helped

Our client decided to contact Irwin Mitchell’s specialist Serious Injury team and one of our experienced partners, Stephen Nye, was able to deal with his claim. With Stephen’s help, we were able to secure our client a seven figure sum in compensation, in an out of court settlement.

Stephen Nye commented: "Our client was only out for a leisure ride on a nice sunny day and because of the inattention of a driver of a farm vehicle, he has suffered life changing injuries. The case was hard fought, liability being denied throughout and my client being blamed for the accident. A detailed, forensic investigation was undertaken, which enabled us to establish a case against the farm vehicle driver.

"The court rules require the parties to such cases to attempt to resolve matters before trial and we were able to secure a very advantageous settlement for our client as a result.

"The substantial seven figure sum he has been awarded will provide future financial security and will give him the funds to purchase a suitable, single storey property and to make better arrangements for his care.

"My client faced his injuries with bravery and positivity and he has become an active fund raiser for a spinal cord injury charity (Back Up)".
