D, a 45 year old man, instructed Graysons Solicitors in 2000 to act on his behalf in claiming compensation for vibration white finger under a governmental scheme set up for ex-miners. Graysons failed to submit the questionnaire for loss of services within the deadline set by the order governing the scheme, resulting in the Claimant being barred from recovering this head of loss.
With the help of Mark Aldridge from the Professional Negligence Team at Irwin Mitchell, D brought a claim against the Solicitors responsible for missing the deadline. This was settled out of Court for the sum of £7,000.
