We acted for a client in relation to a dispute with a contractor regarding the specification of works to be carried out.
Our client was a management company who had invited tenders for refurbishment works to be carried out to the common areas of a development. The specification for the works was set out in the tender documents which were provided to the successful contractor. They provided that the contractor was to apply three coats of paint to the external woodwork on the development. Whilst monitoring the works our client noticed that only two coats of paint were being applied.
As an alternative to court proceedings, the contract provided for disputes to be referred to adjudication. The contractor therefore referred the matter to the adjudicator. We conducted settlement negotiations on behalf of our client and acted in relation to the adjudication.
