Katrina Elsey, public liability specialist, is urging users of mobility scooters to take more care when driving their vehicles in pedestrian areas.
Our client suffered a broken leg, which became infected with MRSA, when she was hit by a scooter in Retford.
Our client was out shopping with her husband on 2 February 2008 when she was knocked down by the vehicle, which was travelling through Retford Market Square.
The crash left our client's leg trapped under the scooter and she was dragged along the road when the driver, failed to stop after the accident. He later pleaded guilty to reckless assault causing actual bodily harm at Retford Magistrates Court, and was given a 12 month Conditional Discharge.
Katrina Elsey, public liability specialist at Irwin Mitchell, said: “It is important that users of mobility scooters take care when driving their vehicles and are clear on the laws for using them on pavements and pedestrian areas.
“The speed limit is much lower for pavements and pedestrian areas in order to protect pedestrians, and it is important that users ensure they drive carefully when there are other people around.
“Many people rely on mobility scooters to get around and they are often ridden without training and insurance. Whilst no training or insurance is required to use a scooter, we need to ensure that everyone who uses them does so safely and securely without harming others.”
The accident left our client with a broken left leg, and she had to be taken by ambulance to Bassetlaw Hospital to undergo surgery. She also suffered a serious knee injury as a result of the accident and was kept in hospital for eight days.
Our client needed help around the house for over six months and was unable to do many of the things she usually enjoyed doing.
Katrina Elsey negotiated an out of court settlement of £38,000 with the Defendant's insurers, to go towards our clients ongoing care and rehabilitation.
