Our client worked intermittently for the local council and a number of contractors on the roads, tarmaccing and digging. He was been diagnosed with both a noise induced hearing loss and vibration white finger (VWF) as a result of using jack hammers and compactors.
He was exposed to noise of his own and other colleague's equipment in use and to the vibration of compressed air tools such as jackhammers and compactors.
Our client was never given any hearing protection or rotated in his role to be given breaks away from the vibratory tools. He was doubly unlucky to get both hearing loss and VWF from the work he did.
Letters of Claim were intimated against the client's 2 former employers for both conditions with the client agreeing an out of court settlement for both claims.
The client received 4 figure sums in both claims. Though no admission of liability was ever made, the client was diagnosed with both conditions which have an everyday effect on both his work and home life.
