£350,000 Damages For Holidaymakers Following Illness Outbreak At A Mexican Hotel

A group of 120 people who became ill whilst on holiday in Cancun, Mexico successfully recovered damages against tour operator My Travel totalling more than £350,000.

The holiday makers, whose damages ranged from £397 to £26,619 per person depending on the severity of their illness, fell ill with symptoms of diarrhoea, vomiting and stomach cramps whilst staying at the Viva Azteca Hotel in the Mexican resort during the summer of 2003.

Many of those affected have been left with long term symptoms including Irritable Bowel and Chronic Fatigue Syndrome as a result of their illness.

We initiated a group legal claim on behalf of the holidaymakers against My Travel and were successful in settling all claims and negotiating damages.

We successfully negotiated damages in excess of £350,000 for 120 clients.

Mr and Mrs Rose from Ferryhill, County Durham were 2 such client, who following a two-year legal battle for compensation were successfully awarded approximately £7,000 compensation.

Paul Taylor  and his wife and 2 children travelled to the Viva Azteca Hotel in Mexico. Just days after arriving at the hotel the family all fell ill with diarrhoea and severe stomach cramps. The family’s symptoms were so bad that the hotel doctors had to attend to them.

Mr Taylor’s symptoms continued on his return from the holiday and he has since been diagnosed with suffering from Irritable Bowel Syndrome as a result of the illness he suffered.

The family were awarded in excess of £10,000 in damages.
