A Sheffield woman has received £2500 compensation in a claim against the council.
In November 2006 Ms X was walking up the steps leading back towards her flat in Sheffield. As she was walking up the steps, Ms X caught her foot where some concrete was missing, causing her to trip and fall.
As a result of the accident, Ms X suffered pain in her lumbar back and spine together with aggravation of a pre-existing degenerative change in her lumbar spine.
The claim proceeded against the council as they were the owners of the flats and stairway leading up to the flats. Therefore, it was their responsibility to properly maintain the area.
Liability was admitted and the claim was settled in May 2008 by Katrina Elsey of Irwin Mitchell’s specialist Public Liability team who deal with all forms of accidents in public places including; slips, trips and falls, dog bites and occupiers liability.
She commented, “Local Authorities have a duty to ensure that safe means of access/exits are provided to tenants living within their premises.
“Despite repeated complaints about the steps leading to and from the council flats prior to our client’s accident, the council failed to inspect and repair the steps thereby leaving a hazard to the public.”
