Successful Trip Claim After Injury in Public Place


Protruding manhole cover leads to trip claim

A Sheffield woman has received £4000 in compensation following a trip claim.

Ms X suffered a fractured metatarsal in her left foot when she tripped on a raised manhole cover in the pavement.

A letter of claim was sent to the Sheffield City Council. However, the Council said that the defect was the responsibility of Yorkshire Water. Following investigations, Yorkshire Water and the Sheffield City Council agreed to share liability for the claim on a 50/50 basis.

The out of Court Settlement was reached with help from Katrina Elsey in Irwin Mitchell’s Public Liability Team.

She said, “Had a proper inspection taken place of the area, the protruding manhole cover would have been identified and rectified before the accident.”
