Noise induced hearing loss claim
Mr H from Oldham approached Irwin Mitchell as he noticed that he was suffering from a loss of hearing. Mr H informed Irwin Mitchell that he was employed in the textile industry for approximately 15 years. Mr H worked for various textile mills and after investigation it transpired he worked for Shiloh Spinners Limited and Courtaulds Textiles Limited.
Mr H attended a medical examination and this confirmed that he suffered from a Noise Induced Hearing Loss. The claim was pursued against Shiloh Spinners Limited and Courtaulds Textiles and settled for almost £3,500.00.
Loss of hearing compensation for exposure to excessive noise
Mrs W. from Lancashire came to Irwin Mitchell Solicitors to enquire about a claim for Industrial Deafness. She advised Irwin Mitchell that she was employed by Courtaulds at Talbot Mill as a spinner for over 30 years. She confirmed that she was exposed to excessive levels of noise from the weaving and spinning machines. Mrs W. complained of a loss of hearing which she had first noticed approximately 2 years before approaching Irwin Mitchell. She stated that she had noticed this hearing loss predominantly when she went out socially and some of her friends have commented about her not being able to hear them.
Although it was 15 years since Mrs W. had left the Mill Irwin Mitchell were able to trace the insurers for the company and pursued the claim against Courtaulds Northern Textiles Limited. Mrs W. attended an appointment with a medical specialist and it was confirmed that she suffered from Noise Induced Hearing Loss. The Defendants admitted that they exposed Mrs W. to excessive levels of noise and made an offer of a low four figure sum. After negotiation between Irwin Mitchell and the Defendant’s insurers the amount of the offer was almost trebled.
Industrial deafness: telecoms worker
Mr G worked for BT for most of his working life.
He was engaged in pole erecting and used noisy tools such as jack hammers, wacker plates and compressors.
Because of his noise deafness he required the use of a hearing aid 5 years earlier than he would have done had it not been for his noise induced hearing loss.
IM secured an admission of liability from BT and part of the settlement we were able to recover as damages the costs of the hearing aids together with associated expenses such as batteries.
