Ministry of Defence Claim after Negligent Discharge
£30,000 for injured Infantry soldier after successful Ministry of Defence claim
A settlement of £30,000 was agreed with the Ministry of Defence for this Military Accident on behalf of the Claimant whom was accidentally shot as a result of a negligent discharge while on live firing training exercises in Canada in 2004. The Claimant suffered a superficial gunshot wound to his chest wall and arm. He developed a phobic anxiety associated with firearms and he was medically discharged from the Infantry as a result. He was able to obtain civilian employment in a manual occupation, although with some mild restrictions due to tightness in the affected muscles in the arm.
Liability was admitted by the Ministry of Defence for this accident. The settlement incorporated an amount for the Claimant’s injury, pain and suffering and an amount for the Claimant’s loss of his anticipated military service which based upon the Claimant’s limited service to the date of his discharge was assessed at 7yrs 5 months. The claim also incorporates an amount for the difference in the pension the Claimant would have received had he completed 7yrs 5 months in service and that which he received on his discharge.
