Irwin Mitchell secure damages for client who received negligent surveying advice


Cathryn Selby, on behalf of her clients successfully pursued a surveyor whom her clients had engaged to survey a property that they intended to purchase.

Upon moving into the property it became clear to Cathryn’s clients that there were very serious structural defects with the property. Engineers’ reports were obtained on the extent of the problems. Conclusions were reached that the problems were so extensive that the property was rendered as worthless and beyond repair. Consequently the property was in effect only worth the value of the land.

A claim was pursued against the surveyor for diminution in value which is broadly the overpayment made by the clients in the purchase of the property. These damages were successfully recovered for the clients and the money has allowed Cathryn’s clients to rebuild their home.
